Terms of Service

1. Acceptance
By creating an account or using any part of the Affihub platform (“Service”), you agree to these Terms of Service (“Terms”). If you are accepting on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the Service.
2. Description of service
Affihub provides affiliate program management software, including affiliate tracking, commission calculation, payout processing, a partner portal, and a public program marketplace. The Service is offered as software-as-a-service (SaaS) on a subscription basis.
3. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your credentials.
- You must notify us immediately at support@affihub.com of any unauthorised access.
- One account per person or entity unless explicitly permitted (e.g. Agency workspaces).
- Accounts may not be transferred without our written consent.
4. Acceptable use
You agree not to:
- Use the Service to track, promote, or pay commissions for illegal products or services.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Use automated tools to scrape or abuse the API beyond documented rate limits.
- Misrepresent your identity, company, or the programs you operate.
- Use the Service to send unsolicited bulk email (spam) to affiliates or customers.
- Attempt to gain unauthorised access to any account or system.
- Resell or white-label the Service without a separate written agreement.
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice depending on severity.
5. Subscription and payment
Plans and billing
Paid plans are billed monthly or annually in advance. Prices are listed at affihub.com/pricing. We reserve the right to change pricing with 30 days’ notice. Continued use after the notice period constitutes acceptance.
Tracked revenue cap and overages
Each plan includes a monthly tracked-revenue cap (the gross value of attributed transactions). On paid plans, revenue above the cap is charged an overage fee of 2% of the excess. On the Free plan, attribution stops at the cap — no overage charges apply. Overage fees are invoiced at the start of the following billing period.
Taxes
Prices exclude applicable taxes (VAT, GST, sales tax). You are responsible for applicable taxes in your jurisdiction. We collect and remit taxes where legally required.
Cancellation and refunds
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — no partial refunds except as set out in our 7-day refund policy for first-time subscribers (see Section 6). Downgrading to a lower plan follows the same policy.
6. Refunds
First-time subscribers who cancel within 7 days of their initial paid subscription and have not used paid features (automated payouts, API access, or marketplace listing) may request a full refund by emailing support@affihub.com. We process refunds within 5 business days. After this window, fees are non-refundable.
7. Intellectual property
Affihub and its licensors own all rights in the Service, including software, designs, trademarks, and documentation. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription term.
You retain ownership of your data (campaign configurations, partner records, commission data). By using the Service, you grant us a limited licence to process your data solely to provide and improve the Service.
8. Data and privacy
Our collection and use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference. For enterprise customers requiring a Data Processing Agreement (DPA), contact legal@affihub.com.
9. Service availability and SLA
We target 99.5% monthly uptime for the API and portal. Planned maintenance is announced at least 24 hours in advance. Agency and Enterprise plans include a priority support SLA (24-hour response). Free and Indie plans receive community and email support with best-effort response times.
We are not liable for downtime caused by third-party services (Stripe, Paddle, Cloudflare, Neon), force majeure events, or actions outside our reasonable control.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFIHUB’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL AFFIHUB BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify, defend, and hold harmless Affihub and its officers, directors, and employees from any claims, losses, or damages (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
13. Termination
Either party may terminate at any time: you by cancelling your subscription; we by giving 30 days’ written notice for any reason, or immediately for material breach of these Terms. On termination, your access to the Service ends and we will delete your data within 30 days, except where legal retention requirements apply. You may export your data at any time before termination.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Affihub is incorporated, without regard to conflict-of-laws principles. For disputes under $10,000 USD, either party may elect binding arbitration administered by a recognised arbitration body. For larger disputes, exclusive jurisdiction rests with the courts of that jurisdiction.
Before initiating formal proceedings, both parties agree to attempt good-faith resolution by contacting legal@affihub.com.
15. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. The current version is always at affihub.com/terms.
